Key Compliance Changes Announced
The CRA has officially lifted the moratorium on penalties for failure to report fees for service transactions in the trucking industry. This move is part of a broader initiative to strengthen compliance and address the misclassification of workers, particularly under the “Driver Inc.” model, where drivers are incorrectly treated as independent contractors or personal services businesses rather than employees.
What’s Changing:
- T4A Penalties Reinstated: Trucking companies are now required to issue T4A slips for all non-employee drivers, including owner-operators and incorporated drivers operating as personal services businesses. Failure to do so will result in financial penalties.
- Focused Compliance Program: The CRA is implementing a targeted program to address non-compliance related to personal services businesses and the reporting of fees for service in the trucking sector.
- Information Sharing: Legislative amendments are being proposed to allow the CRA to share taxpayer and confidential information with Employment and Social Development Canada (ESDC) for the purpose of enforcing worker classification rules under the Canada Labour Code.
- Funding: Budget 2025 allocates $77 million over four years, with ongoing funding of $19.2 million annually, to support these compliance efforts.
Why This Matters: These measures are designed to:
- Ensure truck drivers receive the benefits and protections they are entitled to as employees.
- Level the playing field for companies that comply with tax and labour laws.
- Strengthen the integrity of Canada’s tax system and support fair competition in the trucking industry.
What You Need to Do:
- Review your worker classification practices and ensure all required T4A slips are issued for non-employee drivers.
- Prepare for increased compliance reviews and potential information sharing between the CRA and ESDC.
- Stay informed about further legislative changes that may affect your reporting obligations.
